1. Scope of consent
By accepting this Consent, you agree that all agreements, disclosures, notices, statements, records, and other communications that Victoi (or its Partners on its behalf) is required or permitted to provide to you in connection with your use of the Services (collectively, "Communications") may be provided to you electronically.
2. What you are consenting to
Communications may include, but are not limited to:
- these Terms, the Privacy Policy, the Cookie Policy, and the AUP, and updates to them;
- cardholder, brokerage, prediction-market venue, and other Partner agreements;
- account-opening disclosures, including KYC, AML, sanctions, anti-fraud, and risk disclosures;
- transaction confirmations, receipts, account statements, fee schedules, exchange-rate disclosures, and remittance-transfer disclosures (including those required by U.S. Regulation E and 31 C.F.R. Part 1010);
- tax-information statements, including IRS Forms 1099 where applicable;
- periodic statements and balance reports;
- error-resolution notices and dispute updates;
- privacy notices and changes to those notices;
- security alerts, account-recovery messages, and other operational notices;
- marketing communications, where you have not opted out.
3. How we deliver communications
We may deliver Communications by:
- email to the address associated with your account;
- in-app messaging or push notification;
- posting to a secure area of the Victoi website or app;
- SMS to the verified phone number associated with your account;
- any other electronic channel we make available.
A Communication is considered received when sent to the address or device on file or made available within the Services, even if you do not open or read it. We may also use trusted Partner systems to deliver some Communications (for example, a card-issuing Partner's portal for cardholder statements).
4. Hardware & software requirements
To access and retain Communications electronically, you need:
- a computer or mobile device with a current, supported operating system;
- a current version of a major web browser (Chrome, Safari, Firefox, or Edge) or a current version of the Victoi mobile app;
- an active email account, with the ability to receive and read HTML email;
- software capable of viewing PDF documents (most modern browsers and operating systems include this);
- a stable internet connection;
- storage media (local storage or cloud storage) sufficient to retain Communications.
We will notify you if our system requirements change in a way that creates a material risk you might not be able to access or retain Communications.
5. Right to receive paper copies
You may request a paper copy of any Communication that we are required by law to provide to you in writing by emailing legal@victoi.com. We may charge a reasonable fee for paper copies, except where the law prohibits such a charge. Requesting a paper copy of a particular Communication does not by itself withdraw your general consent to electronic delivery.
6. Right to withdraw consent
You may withdraw this Consent at any time by emailing legal@victoi.com with the subject line "Withdraw E-Sign Consent." Withdrawal will be effective after we have had a reasonable time to process the request. Because the Services are delivered through electronic channels, withdrawing consent may require us to close your account and discontinue providing the Services.
7. Keeping your contact information current
You must keep your email address, phone number, and other contact information current in the Services so that we can deliver Communications to you. Update your contact information in the app under Settings › Profile, or by emailing legal@victoi.com.
8. Your consent
By creating an account or otherwise using the Services, you acknowledge that you have read and understand this Consent, that you can access and retain electronic Communications using the systems described above, and that you affirmatively consent to receive Communications electronically as described here. You may print or save a copy of this Consent for your records.
